This Agreement (“Agreement”) is entered between CYBRIX 360 AI LIMITED having its registered office at Level 30, The Leadenhall Building, 122 Leadenhall Street, London EC3V 4AB, United Kingdom, through its website ngage360.app, and ‘You’ as the User on the website. The terms such as ‘Company’, ‘Platform’, and ‘NGage 360’ shall be used in reference to the Platform, and the terms such as ‘You’, ‘User’, and ‘Client’ shall be used in reference to the User of the website.

The Policy explains how NGage 360 (referred to as “we,” “us,” or “our”) collects, uses, and shares personal information, as well as the options available to you regarding this information. Please read this Policy carefully to understand how we handle your personal data. If you do not agree with our practices, please refrain from accessing or using our Websites or Services.

This Policy applies to all personal data collected by NGage 360 through its Websites, software products, and any other interactions you may have with us. However, it does not apply to any third-party websites or businesses that we may link to or that may link to us.

B. WHAT DO WE COLLECT?

  1. We collect various types of personal data that you may provide to us, such as device and connection information (like IP address and browser type), approximate location information based on your IP address, cookies, and tracking technologies that analyze your email interactions and website usage, User Metrics (which include technical logs, login frequency, number of models deployed, and feature usage and engagement), and Metadata (which describes your Customer Data, models, and projects).
  3. If you sign up as a User, we may gather certain details such as your name, company name, telephone number, address and email address. If a Visitor gets in touch with us or inquires about our Service, we will collect their email address and some additional contact information to fulfill their request. We might also inquire about their name, company name, telephone number, and email address. Additionally, we may ask for information about their company, job, and professional background. While you explore our Website, your browser may send us log data, which could contain information such as your IP address, browser type, browser version, pages visited, date and time of visit, length of time spent on those pages, and referring pages.
  4. If you want to receive a newsletter or access additional content through our Websites, we will collect Personal Data, such as your name and email address, so that we can send you the newsletter.   6. Information that we may obtain from third parties includes business contact information, which we may receive from event co-hosts, B2B intelligence platforms, or obtain publicly available data from third-party sources, such as social media.
C. HOW DO WE USE YOUR DATA?
  1. The way we use your personal information depends on your interactions with us, and we have listed specific purposes for using the data we collect from you below. In some places, such as those that are subject to GDPR, we can only process your personal data if we have a legal basis for doing so.     • Carrying out our contractual obligations to you;

E. DATA RETENTION

  1. We will keep your personal information for as long as necessary to fulfill the reasons for which it was collected. This could include providing you with services, meeting our business requirements and legal obligations, settling disputes, and enforcing our rights and agreements.
  2. After you terminate or deactivate your account, we will delete your Customer Data within 30 days, and make your User Metrics anonymous. However, we may still keep your contact information, user profile, and other personal data in our records. Once the purpose for which we collected your personal data is no longer applicable, and there is no business or legal reason to retain it, we will securely delete or anonymize your data. If you want us to delete your personal data before the end of our retention period, please refer to the Contact Us section.
F. DATA SECURITY
  1. Ensuring the security of your data is a top priority for us. To safeguard against unauthorized access, alteration, or destruction of your personal data, we have implemented various measures, including organizational, technical, and physical precautions.
  2. Although we adhere to industry standards and best practices for data protection, it is important to note that no transmission of data over the internet or any public network can be completely guaranteed to be completely secure.
G. YOUR DATA RIGHTS
  1. We respect your right to control your personal data and will confirm upon request whether we hold or process data collected from you. You have the right to amend or update any inaccurate or incomplete personal data, request deletion of your personal data, or request that we no longer use it. However, we may not be able to fulfill your request under certain circumstances, such as regulatory obligations, legal matters, inability to verify your identity, or disproportionate cost or effort. We will respond to your request within a reasonable timeframe and provide you with an explanation. You can exercise these rights by contacting us through the provided methods.
H. MISCELLANEOUS
  1. When you make a purchase with us, your payment card information is collected and processed by our payment processor. We do not receive or store your full payment card information. We suggest that you read the payment processor’s privacy policy before making a purchase.
  2. Our Services and Websites are not intended for individuals under the age of 18. If a parent or guardian becomes aware that their child under the age of 18 has provided us with personal data, they can contact us and we will make an effort to delete the child’s data as soon as possible.
  3. If you have an account through our Websites or use our Services, you can view, update, and delete certain information directly through your account.
  4. You can opt out of receiving future marketing communications from us by clicking the unsubscribe link in a marketing email, responding to our emails with the subject line “Opt Out,” or updating your profile settings. Please note that you cannot generally opt out of service-related communications.
  5. You or your administrator may be able to deactivate your account if you want to stop using our Services. However, depending on how you use our Services and Websites, this may not delete all of your information.
